These Terms of Service ("Terms") govern your use of the TechGnome LV LLC ("TechGnome LV," "we," "us," or "our") website at techgnomelv.com and the IT services we provide. By using our website or engaging our services, you agree to be bound by these Terms.

Acceptance of Terms

By accessing our website or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

Services Description

TechGnome LV provides IT services in the Las Vegas, Nevada metropolitan area, including but not limited to:

  • PC repair, maintenance, and upgrades
  • Security surveillance system installation and maintenance
  • Custom web development, hosting, and SEO services
  • AI automation solutions and consulting

The specific scope, timeline, and pricing for each engagement will be detailed in a separate work order, quote, or service agreement provided before work begins.

Service Agreements

All services are performed pursuant to a work order or written quote that specifies:

  • The scope of work to be performed
  • Estimated timeline for completion
  • Pricing and payment terms
  • Any applicable warranty terms

Work will not begin until the client has reviewed and accepted the quote or work order. Any changes to the scope of work after acceptance may result in additional charges, which will be communicated and approved before proceeding.

Payment Terms

Payment is due upon completion of services unless otherwise specified in a written agreement. The following payment terms apply:

  • We accept cash, check, credit card, and electronic payment methods.
  • For projects exceeding $1,000, we may require a deposit of up to 50% before work begins.
  • Late payments may be subject to a late fee of 1.5% per month on the outstanding balance.
  • If payment is not received within 30 days of the invoice date, we reserve the right to suspend services until the account is brought current.

Warranty

TechGnome LV stands behind the quality of our work:

  • Repairs: We provide a 30-day warranty on all repair services. If the same issue recurs within 30 days of the original repair, we will re-examine and fix the issue at no additional charge.
  • Installations: Surveillance installations and hardware installations carry a 1-year warranty on labor. Hardware is covered by the manufacturer's warranty.
  • Web Development: We provide 30 days of bug fixes after launch for any issues related to the agreed-upon scope of work.
  • Exclusions: Warranties do not cover damage caused by misuse, physical damage, power surges, software installed by the client after service, or unauthorized modifications.

Limitation of Liability

To the fullest extent permitted by law, TechGnome LV LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with our services.

Our total liability for any claim arising out of or relating to our services shall not exceed the total amount paid by the client for the specific service giving rise to the claim.

We are not responsible for data loss during repairs. While we take every precaution to protect client data, we strongly recommend backing up all data before any service appointment. We are not liable for pre-existing hardware or software conditions not disclosed to us before the start of service.

Intellectual Property

All content on the TechGnome LV website, including text, graphics, logos, icons, images, and software, is the property of TechGnome LV LLC and is protected by United States copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our website content without prior written permission.

For web development and AI automation projects: upon full payment, the client retains ownership of all custom work product created specifically for them, including custom code, designs, and content. TechGnome LV retains the right to use general techniques, tools, and non-proprietary components in future projects.

SMS/Text Messaging Terms

By opting in to receive text messages from TechGnome LV LLC, you agree to the following terms:

  • Consent: By checking the SMS consent box on our contact form or by texting us directly, you expressly consent to receive text messages from TechGnome LV at the phone number you provided. Consent is not a condition of purchasing any goods or services.
  • Types of Messages: Messages may include appointment confirmations, service updates, follow-up communications, quotes, and other information related to your service request.
  • Message Frequency: Message frequency varies based on your service requests and account activity. You will not receive more than 10 messages per month unless you initiate additional conversations.
  • Costs: Message and data rates may apply. TechGnome LV does not charge for text messages, but your wireless carrier may charge standard messaging fees. Check with your carrier for details.
  • Opt-Out: You may opt out at any time by replying STOP to any text message from TechGnome LV. You will receive a one-time confirmation that you have been unsubscribed. No further messages will be sent unless you re-opt in.
  • Help: For assistance, reply HELP to any text message from TechGnome LV, or contact us at info@techgnomelv.com or 725-241-9996.
  • Privacy: Your phone number and personal information are handled in accordance with our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. We will not sell, share, or rent your SMS opt-in information to any third party for any reason other than to deliver the specific services associated with your request. However, we may share your personal data, including your SMS opt-in or consent status, with third parties that assist us in providing messaging services, such as platform providers, phone carriers, and other vendors involved in delivering text messages.
  • Supported Carriers: Compatible with major US carriers including AT&T, T-Mobile, Verizon, and Sprint/T-Mobile. Carriers are not liable for delayed or undelivered messages.
  • Liability: TechGnome LV is not responsible for incomplete, lost, late, or misdirected messages, including but not limited to messages that are undeliverable as a result of any form of filtering applied by your wireless carrier or third-party service provider.

Email Communications

By providing your email address and submitting a request through our website, you consent to receive transactional emails from TechGnome LV related to the services you requested, including quotes, invoices, appointment confirmations, and project updates.

If you opt in to receive promotional emails, you may unsubscribe at any time by clicking the "Unsubscribe" link in any promotional email or by contacting us at info@techgnomelv.com. In accordance with the CAN-SPAM Act, we will honor unsubscribe requests within 10 business days.

Telephone Communications

By providing your phone number and submitting a service request, you consent to receive telephone calls from TechGnome LV related to the services you requested. We do not use automated dialing systems or prerecorded messages for marketing purposes. Service-related calls may include appointment scheduling, service updates, quote discussions, and follow-up on completed work.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or our services shall be resolved exclusively in the state or federal courts located in Clark County, Nevada.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. Continued use of our website or services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
